The NDIS Commission provides market oversight by collecting, analysing and advising on a range of unique data to identify trends and changes in the NDIS market.

This information highlights the emerging benefits and risks, service delivery trends, quality issues and other important factors that help governments and the market to shape the NDIS over time.

This market oversight role complements the NDIA’s planning and scheme management role but does not replace it.

To support understanding of the market landscape, the NDIS Commission conducted a high-level analysis of complaints data for the period 1 October 2023 to 31 December 2023.

Price differentiation summary report

The NDIS Commission is working with the Australian Competition and Consumer Commission (ACCC), Department of Social Services (DSS) and the National Disability Insurance Agency (NDIA) to address price differentiation within the NDIS market.

  • In December 2023 the NDIS Code of Conduct included a rule about price differentiation, specifically the price for providing goods.
  • This summary report looks at the data about the complaints made to the NDIS commission from July 2018 to September 2023. It explores complaints related to pricing, including:
    • overcharging
    • participants being charged for more hours of support than they received
    • charges for non-face-to-face items like report writing, travel or cancellation fees for appointments cancelled by a provider
    • someone being charged a different price for the same service or product because they are a NDIS participant.
  • The report findings will be used when we plan strategies to reduce price differentiation in the NDIS market. This may include making the rules cover price differentiation for NDIS services as well as goods.
