Victorian-based entities and individuals banned

The NDIS Quality and Safeguards Commission (NDIS Commission) has taken compliance action against two Victorian-based entities and five associated individuals.

Williams Landing-based Millennium Disability Care Pty Ltd has been issued a banning order, permanently prohibiting it from providing NDIS supports and services to people with disability.

Sarah Michael Leen Manyok Thiak, director of Millennium Disability Care Pty Ltd, and five associated entities and individuals have also been issued banning orders, with prohibitions ranging from five years to permanent. Millennium Disability Care Pty Ltd’s registration has also been revoked.

In coordination with the Fraud Fusion Taskforce recently established to investigate fraud against the NDIS, the NDIS Commission took action after obtaining evidence of the submission of falsified and inappropriate claims for payment to the NDIS, which had serious adverse effect on NDIS participants’ mental and physical wellbeing.

The NDIS Commission immediately suspended the registration of Millennium Disability Care Pty Ltd, on grounds that a delegate of the NDIS Commissioner had formed a reasonable belief that Millennium Disability Care Pty Ltd:

  • had breached the National Disability Insurance Scheme Act 2013, including the NDIS Code of Conduct; and
  • is not suitable to be involved in providing supports or services to people with disability.

“The NDIS Commission will take swift action where NDIS providers and their key personnel fail to meet their obligations and in circumstances where they are no longer suitable to deliver NDIS supports and services,” NDIS Commissioner Tracy Mackey said.

“The NDIS Commission continues to work closely with the NDIA and other government agencies to identify and address quality and safeguarding concerns, including those arising from engagement in fraudulent activity. NDIS providers have very clear obligations and we will take action when providers do not meet those obligations.”
