Statement regarding banning order in respect of Rosa Maria Maione

The NDIS Quality and Safeguards Commission (NDIS Commission) can make the following statement regarding the banning order made in respect of Rosa Maria Maione.

“A banning order has been made by a delegate of the NDIS Commissioner against Ms Maione, the carer of Ms Anne-Marie Smith an NDIS Participant who died in appalling circumstances in April 2020. The banning order took effect from Friday 18 December 2020 at 5pm.

The banning order prohibits Ms Maione from providing disability supports and services, directly or indirectly, to NDIS-funded participants.

In making the banning order the NDIS Commission recognised that there are criminal proceedings underway which should be allowed to proceed in a fair and impartial manner. Ms Maione has been charged by South Australian Police with the manslaughter of Ms Smith.

The banning order has been made for a period of 5 (five) years to allow adequate time for an outcome to be reached in those criminal proceedings.

On the outcome of the criminal proceedings the NDIS Commission will review the banning order.”
